What's a contract?
Making a bargain with another. It is that simple. When you make a deal with some entity that is not you you are making a contract.
Who are the parties?
Too often lawyers do not ask themselves "...and who the heck are you?" Figuring our exactly who is involved in a contract is one of the most important questions.

Trade secrets are all important in software contracting as what is being bought and sold are text-based instructions for machines. Sounds a bit duller than code but there you have it.
