It is an interesting case and one which, I think, makes a good deal of sense. And it would make sense even without the aboriginal issues.

The original sentence was well beyond stiff for a contempt citation. After all the objective of contempt proceedings is to ensure compliance with the Orders of the Courts. In the first instance of contempt it makes a lot of sense to impose a small fine and release on an undertaking not to repeat the contempt. The authority of the Court is affirmed but the point of the protesters will have been made. A second instance of the contempt, particularly if undertakings have been given should lead to a significantly larger fine and a limited custodial sentence.

Of course, three and you get to spend more than a long weekend as the guest of Her Majesty.

I suspect this case will be noted by our blockading aboriginal friends as well as assorted enviros. For the general sake of the rule of law I rather hope the contemptors take this up to the next level so that the Court has the opportunity to indicate that, "No, this time we mean it."

Interestingly, there was no blockade here and no enviros but a coalition of a small fairly quiet first nation and a strong presence of non-aboriginal local residents, something that does not get as much attention as other elements. I suspect what you will see is, however, is not further appeal but recourse to consultation and, as uranium is involved, a fairly robust process.
