It is quite interesting to follow the gnashing of teeth on the US based blogs I read about the Supreme Court of that fair land's ruling this week that municipalities can expropriate people's own lands to gather it together and give it to a developer to build a project. Go read Kip for a lawyer's view; NYCO for her analysis that compares present-day land ownership to First Nations' land; and Michael chides over the meaning of freedom. I may see if I can pull some principles in the Ontario Expropriation Act to see such things are actually done up here.

I should do up a blog on this, but I've already seen my opinion spreading across the blogosphere. With this ruling, I fear that we'll see more instances of businesses donating to elected officials' campaigns, and then demanding their support when it comes to getting eminent domain for a piece of land. Then you'll run into the inevitable lawsuits filed by people/businesses that already occupy said property, which will end up costing taxpayers money since the municipality approving the eminent domain will be the once to get sued (face cease & desist orders etc.). It's just bad news all around. Talk about kicking more legs out from under campaign finance reform.

The Angry Man (who I almost always disagree with but inevitably agreeably so) interestingly links to the Authorson case on the vested pension rights of disabled vets which were taken away by the Federal government. It is interesting as I do not think of that as a property case but, yet, it makes me think - I think of "propery rights" as the rights to land and exclusion and all that. Here is my last link about that case. I will have to think a wee bit more.
