Ben -

May I ask what you're basing the comparison with Georgia on? The colony of Georgia was chartered in 1733 while their constitution wasn't written until 1788. Were there noother new colonies/territories established during the window?

Alan -

I seem to recall that the Georgia constitution was the next one after 1769 and there may have been a Georgian constitution before the 1788 one. I am relying on dim recollection of a 1948 law article on the pre-confederation constitutions which I have stowed away somewhere but I sure it is Georgia.

A lovely illustration of the odd isolationism can be found simply in today's PEI speech from the Throne's title: "A Clear Direction, Putting Islanders First." As opposed to, you know, Wisconsins and Norwegians who have been getting all the goodies to date. <p>It is somewhat ominious, however, in the tiny sense considering the common practice of proclaiming all non-third generation borne residents (other than those whose ancestors were there pre-1722) are not "Islanders".

Get ready for a short fight: <blockquote class="smalltext"> Ottawa has notified the PEI government that it is seeking a court date for a motion to dismiss the lawsuit filed in February.</blockquote>Perhaps it is because PEI cannot being a Charter argument as it is not a person. This may come as a shock to the population which, as I recall, voted a fictional character as the person of the 20th century.<p>I may have it all wrong, however, as it appears the case may be over rule of law and division of powers but that still makes me wonder what wrong the province might have suffered itself.

By the way, do you think the mini-Minister of Fish might have been wanting to say "defend" rather than "contest"?<blockquote class="smalltext">"This manoeuvre on the part of the federal government was not unexpected, and we will vigorously contest our right to proceed with the lawsuit," Mr. MacAdam said in a news release.</blockquote>

This will come as a shock, but I regret to point out L.M. Montgomery was not "a fictional character"!

:)

Didn't CBC PEI award Anne of GG the prize? It's been two year away now Wayne so you can't expect me to get everything right.

The Supreme Court of Canada put this one where it belongs a few weeks after the authors of the law suit got the boot by the population.
