I was thinking more about this post and the quote copied from Jean's Tingley's PEI election blog. What laws are involved? Perhaps Criminal Code sub-section 121(2)
(2) Every one commits an offence who, in order to obtain or retain a contract with the government, or as a term of any such contract, whether express or implied, directly or indirectly subscribes or gives, or agrees to subscribe or give, to any person any valuable considerationIs the vote the "valuable consideration" needed to be exchanged in return for the contract sought and refused by Jean? Was the refused offer an attempt under section 24?(a) for the purpose of promoting the election of a candidate or a class or party of candidates to Parliament or the legislature of a province; or(b) with intent to influence or affect in any way the result of an election conducted for the purpose of electing persons to serve in Parliament or the legislature of a province.
24. (1) Every one who, having an intent to commit an offence, does or omits to do anything for the purpose of carrying out the intention is guilty of an attempt to commit the offence whether or not it was possible under the circumstances to commit the offence.(2) The question whether an act or omission by a person who has an intent to commit an offence is or is not mere preparation to commit the offence, and too remote to constitute an attempt to commit the offence, is a question of law.
Surely not too remote if the person was prepared with the paper for signing. Could it be??? Nice to see, if so, this offence - attempting a 121(b) - is a pure indictable offence. The hoosgow for you!
Interesting to see that it is not apparently an offence under the PEI Elections Act - you have to threaten violence...unless maybe under section 28(b):
Every person is guilty of an offence, where, in order to induce or compel an elector to vote for any candidate...otherwise interferes with the free exercise of the franchise of an elector.But that would be the bagman offence, though, not the voter offence.
